Terms and Conditions

§ 1 General Provisions

These General Terms and Conditions apply to all services provided by JSJ Tiny Life GmbH (“TINY SPACE”). Users accept these terms by submitting a contract offer. Individual contracts take precedence, with the GTC serving as supplementary. User terms conflicting with these conditions have no validity without written confirmation from TINY SPACE. The offering targets business operators only — defined as natural or legal persons acting in a commercial or self-employed capacity. Changes to the GTC are governed by § 20.

§ 2 Contract Conclusion

Users make binding contract offers through online booking, phone booking, or completing forms at TINY SPACE premises. TINY SPACE accepts offers in writing or via email, though contracts exceeding one-year terms follow statutory written form requirements. TINY SPACE may reject any offer without providing reasons. Users confirm their information is complete and accurate, and must promptly correct any inaccuracies or omissions occurring during the contract duration.

§ 3 Services

TINY SPACE offers space usage and additional services at multiple locations during specified operating hours. Pricing appears in individual contracts. Service details are outlined in Attachment 1 (Service Description) and house rules. These attachments, combined with the usage contract, represent the complete service scope. Users have no claims beyond contracted services. Any benefits beyond contractual terms constitute goodwill only and create no legal entitlements. TINY SPACE may withdraw such benefits at any time. Extra services may require additional compensation. Booked services are non-transferable without written TINY SPACE consent.

§ 4 Additional Services

Extra options become monthly-renewable after minimum booking periods. A minimum monthly fee applies even for shorter usage. To discontinue extras before main contract expiration, users must notify TINY SPACE one week before contract end. Continued use implies acceptance of ongoing charges without guaranteeing further access. TINY SPACE may similarly cancel extras with one-week notice to period end.

§ 5 Usage

Users may utilize booked spaces as offices or meeting rooms; other uses require permission. Before use, users conduct a brief check for visible damage or dirt, notifying TINY SPACE via photo evidence at hello@tinyspace.com if found. Damage during use requires immediate staff notification. TINY SPACE reserves the right to collect damages or cleaning fees (base fee €20, higher in special cases) via stored payment methods, calculated at replacement/repair cost. Users maintain traffic safety obligations for exclusively-used areas. TINY SPACE may cancel bookings at short notice for special occasions or repairs, offering alternatives. If a location change (typically nearby) proves unreasonable, users may request refunds, which extinguish all claims.

§ 6 Subletting

Subletting booked spaces without TINY SPACE permission is prohibited. TINY SPACE may refuse permission for valid reasons; users may terminate only if refusal was unjustified. TINY SPACE may charge a surcharge (maximum 20% of the last usage fee). Half of subletting profits must be remitted to TINY SPACE.

§ 7 Internet Usage

Users must respect all applicable local, national, and international laws, particularly German law in data traffic. Users alone bear responsibility for all internet actions. Users face legal restrictions on content retrieval, storage, transmission, distribution, and display — especially regarding copyright. Copying, distributing, or downloading copyrighted music/films is strictly prohibited. Violations causing damage to TINY SPACE require user compensation; TINY SPACE may terminate the framework agreement immediately.

Users must not attempt unauthorized infrastructure access. Users confirm they will not use TINY SPACE services/infrastructure for:

  • Contest/lottery-related activities, MLM schemes, chain letters, spam, or unsolicited advertising
  • Defamation, abuse, harassment, stalking, hate speech, threats, or privacy/personality rights violations
  • Distributing offensive, pornographic, or illegal materials/data
  • Distributing virus/trojan/worm/bot/malware-containing data
  • Illegal downloading of copyrighted data
  • Activities causing noise, odor, or disturbance
  • False identity claims

§ 8 Payment

For bookings up to one month, usage fees are due immediately upon confirmation. If spaces remain unoccupied following booking, users may extend without penalty. Bookings are complete only after users actively lock doors via code. TINY SPACE charges €2.50 per 15-minute overage.

For indefinite-term services, multi-month bookings, or auto-renewing services, fees are due in advance on the third business day of each usage month. Payment timeliness is measured by account receipt. Late payment incurs €10 processing fees per instance (though users may prove lower damages). Payment delays allow TINY SPACE to refuse further bookings/access until full payment including penalties.

Accepted payment methods: credit card, PayPal, or SEPA direct debit. Direct debit processes one day post-invoice, with shortened pre-notification (1 day). Users ensure account funding. Non-clearance/chargeback costs fall to users unless TINY SPACE caused them.

§ 9 Contract Duration

Hour/day-based services begin and end at actual usage times. Users must vacate promptly for subsequent bookings. Start dates of indefinite-term services are specified in contracts. Monthly-renewal services begin on the stated date, ending the following month on the numerically corresponding day (or month-end if no match exists). This period is called the “contract month.”

§ 10 Termination

Fixed-term services cannot be ordinarily terminated during contract periods, though extraordinary termination rights remain. Post-expiration termination follows contract terms. Monthly-renewal extras (§ 4) terminate with one-week notice after minimum periods. Other monthly services terminate with one-month notice to month-end after any minimum period.

Beyond statutory grounds, TINY SPACE may immediately terminate if:

  • Usage fees are not paid when due
  • Fees are not paid after one-week notice, or payment fails at two consecutive terms or twice within six months
  • User seriously or repeatedly breaches contract terms
  • User violates § 7 obligations (internet usage)
